Thank you for choosing Kolamar! When we say "we," "us," or "our," we're referring to Kolamar. We run this website and store, along with all the related information, content, features, tools, products and services designed to give you, our customer, an excellent shopping experience (the "Services"). Shopify powers Kolamar, allowing us to deliver the Services to you.
The terms and conditions below, along with any related policies (collectively called these "Terms of Service" or "Terms"), explain your rights and obligations when you use the Services.

When using the Services, browsing our online store, or buying products or services we offer, you may need to provide certain details like your email, billing address, payment method, and shipping information. You guarantee that all information you supply is accurate, up-to-date, and complete, and that you have authorization to share this information.
It's your responsibility alone to keep your account credentials secure and to oversee all activities on your account. You cannot transfer, sell, assign, or give your account to someone else.

SECTION 2 - PRODUCT INFORMATION AND AVAILABILITY
We've worked hard to ensure our online store displays products and services accurately. However, be aware that the colors and appearance of items may look different on your screen depending on what device you're using and how it's configured.
We cannot promise that any products or services you purchase will match your expectations or appear exactly as shown in our online store.
Product descriptions may change at any moment in our sole judgment. We're free to stop selling any item at any time and may limit how many of any product we sell to any person, region, or location as we see fit.

SECTION 3 - PLACING YOUR ORDER
When you submit an order, you're making an offer to buy. Kolamar has the right to accept or reject your order at our discretion. Your order becomes accepted only when Kolamar confirms it. We need to collect and process your payment before your order counts as accepted. Make sure to carefully review your order before you send it, since Kolamar might not be able to cancel it once it's accepted. If we reject, modify, or cancel your order, we'll try to reach you using the email, mailing address, or phone number you gave us when you placed it.
Our Refund Policy [LINK] is the only way products can be returned or exchanged.
You're confirming that your purchase is for your own use or for your household—not for business resale or to ship out of the country.

SECTION 4 - PRICING, PAYMENT, AND BILLING DETAILS
Prices, deals, and special offers may change without warning. When you place your order, you'll pay the price that's current at that moment, and this price will show up in your order confirmation email. Tax, shipping, handling, customs, or import costs are not included in posted prices unless we specifically say so.
What we charge online might differ from prices in our physical locations or on other retailers' websites. We occasionally run promotions with their own separate terms and conditions. If a promotion's terms conflict with these Terms, the promotion's terms take priority.
You're agreeing to supply accurate, current, and complete purchase, payment, and account information for all transactions. Keep your account and payment details current—including your email, card numbers, and expiration dates—so we can process your orders and contact you when needed.
You confirm that: (i) your credit card information is valid and correct; (ii) you're allowed to use this card for the purchase; (iii) your credit card company will cover the charges you make; and (iv) you'll pay the full amount at the listed prices, including any applicable shipping, handling, and taxes.

SECTION 5 - SHIPPING, DELIVERY, AND RISK OF LOSS
We're not responsible for delays in shipping or delivery. Delivery timeframes are estimates only and aren't assured. Delays caused by carriers, customs, or unforeseeable circumstances are not our responsibility. Once the carrier takes the products, ownership and responsibility for any loss transfer to you.

SECTION 6 - PROTECTING OUR INTELLECTUAL PROPERTY
Every element of the Services—including brand names, trademarks, text, images, graphics, product reviews, videos, audio, design, selection, and organization—belongs to Kolamar, its affiliates, or our partners and is safeguarded by U.S. and worldwide patent, copyright, and other intellectual property laws.
These Terms allow you to use the Services only for personal, non-business purposes. You're not allowed to copy, share, change, make new versions of, publicly show, publicly perform, repost, save, or send any content from the Services without our written permission first. Beyond what's stated here, these Terms don't grant any license or rights under any patent, trademark, copyright, or intellectual property owned by Kolamar, Shopify, or anyone else. Using the Services without permission might break federal and state laws protecting intellectual property. Kolamar keeps all rights we haven't specifically given you.
Kolamar's names, symbols, product names, service names, designs, and catchphrases are our trademarks or those of our affiliates or partners. Don't use these trademarks without Kolamar's written approval. Shopify has its own trademarks, symbols, product names, service names, designs, and catchphrases. All other names, logos, product names, service names, designs, and catchphrases you see on the Services are the property of their respective owners.

SECTION 7 - THIRD-PARTY TOOLS AND RESOURCES
The Services might include tools made available by other companies. We don't oversee, control, or influence these tools in any way.
You understand and accept that third-party tools are supplied "as-is" and "as available" with no warranties, promises, or conditions of any kind, and we don't endorse them. We accept no responsibility from your use of these outside tools.
Using any third-party tools found through the site is entirely up to you and happens at your own risk. Get familiar with and approve the terms set by whichever company provides the tool.
We may introduce new features to the Services down the road (which could include new tools and resources). Any new additions will be considered part of the Services and will follow these Terms of Service.

SECTION 8 - LINKS TO OUTSIDE WEBSITES
The Services may contain materials and links to sites managed by third parties (including features from outside companies). We don't assess or check the reliability of third-party materials or websites that you choose to visit. If you choose to go to these materials or websites, you're doing so at your own risk.
We have no responsibility for any injury, damage, or issues from accessing third-party sites, or from purchasing or using any products, services, information, or materials on those sites. Look carefully at any third-party policies before you do business with them. Complaints about third-party products and services should go directly to the third-party vendor.

SECTION 9 - HOW SHOPIFY AND KOLAMAR WORK TOGETHER

Shopify provides the infrastructure that allows us to operate Kolamar and deliver the Services to you. Your purchases in our store are transactions directly between you and Kolamar. By accessing the Services, you acknowledge that Shopify doesn't have involvement in any sales between you and us, and isn't liable for any damage, injury, or loss from the products and services you buy. You agree to release Shopify and its partner companies from any claims, damages, or legal responsibility that come from your business with Kolamar.

SECTION 10 - HOW WE HANDLE YOUR INFORMATION
Any personal data collected through the Services is covered by our Privacy Policy, available here [LINK]. Shopify's Privacy Policy [LINK] may also apply to some of your data. By using the Services, you're confirming you've reviewed both privacy policies.
Since our Services run on Shopify's platform, Shopify gathers and handles personal information about how you visit and use the Services in order to supply and better the Services. Information you enter into the Services gets shared with Shopify and potentially with other companies outside your country to help deliver services to you. SECTION 11 - USING YOUR FEEDBACK AND CONTENT
If you give us any ideas, suggestions, comments, reviews, plans, content, or anything else (called "Feedback"), you're letting us use it forever, globally, and we can let others use it too, without paying you. We don't need your permission to change it, post it, give it out, or display it in any form. For example, we might use your Feedback to run, deliver, test, grow, improve, and market the Services.
You're stating that: (i) you own the Feedback or have the rights to give it to us; (ii) you've told us about any money or rewards you got for submitting the Feedback; and (iii) your Feedback follows these Terms. We don't have to keep your Feedback private, pay you for it, or respond to it.
We may remove, edit, or refuse Feedback that we feel is unlawful, mean, dangerous, false, explicit, gross, or otherwise inappropriate or breaks anyone's rights or these Terms—but we don't have to.
You're guaranteeing that your Feedback won't violate anyone else's rights, like copyright, trademark, or privacy rights. You also promise it won't contain anything libelous, illegal, abusive, vulgar, or any computer virus or harmful code that could hurt the Services or any related site. Don't use a fake email, pretend to be someone else, or trick us or others about where your Feedback comes from. You're accountable for the accuracy of your Feedback. We're not responsible for Feedback from you or anyone else.

SECTION 12 - TYPOS, MISTAKES, AND MISSING INFO
Sometimes the Services might have spelling errors, mistakes, or missing information about product details, prices, promotions, offers, shipping charges, delivery times, or what's in stock. We can fix any errors, mistakes, or gaps, or change and update any information or orders if something's wrong—without telling you first (even after you've placed an order).

SECTION 13 - RULES FOR USING THE SERVICES
Use the Services only for legal reasons. You may not access or use the Services, in any way: (a) for anything against the law or for bad reasons; (b) to breach any worldwide, national, regional, state, or local laws or guidelines; (c) to violate our intellectual property or anyone else's; (d) to hurt, insult, abuse, embarrass, harass, scare, or harm any staff member or other person; (e) to put out false or wrong information; (f) to send, get, upload, download, use, or reuse anything that breaks these Terms; (g) to send ads or promotions, including spam or chain mail; (h) to pretend to be another person or group; or (i) to do anything else that blocks or prevents people from using the Services, or that could hurt Kolamar, Shopify, or our users, or make them legally responsible.
Also, you can't: (a) put up viruses or anything else malicious that could mess with how the Services work; (b) copy, duplicate, take part of, sell, resell, or benefit from any part of the Services; (c) gather or monitor anyone's personal data; (d) use spam, phishing, or other tricks on the Services; (e) use any bot, crawler, scraping tool, collection device, AI system (like agentic AI), or any other way to get into the Services; or (f) mess with, get past, or get around our security, access controls, headers that block bots, or anything else we use to keep people out of the Services. We have the right to turn off, restrict, or end your account anytime, without warning, if you violate any part of these Terms.

SECTION 14 - AUTOMATED AGENTS AND SOFTWARE
14.1 These rules ("Agent Terms") apply if you use, permit, activate, or allow any Agent to reach, use, or work with the Services. "Agent" is any program or service that performs independent or partially independent tasks on your behalf or at your request and can work on your gadget without real-time human involvement.
14.2 Any Agent must always identify itself and follow the rules in part 14.4 before accessing, using, or engaging with Services. Don't use any Agent to access, use, or interact with Services if we've asked it to stop.
14.3 We can control how and whether Agents can reach, use, and work with Services through technical methods if we want to.
14.4 Agents have to: (i) in every HTTP/HTTPS message, say it's an Agent and tell us its name by adding this to the user agent part of the request: "Agent/[agent name]"; (ii) not hide or disguise that it's an Agent, including by (a) copying how people act and interact, or (b) getting past CAPTCHAs or tests meant to tell computers from people, (iii) answer truthfully if someone asks if it's human or a computer, (iv) not bypass or dodge anything we use to stop, limit, adjust, or manage how Agents reach, use, or interact with the Services.

SECTION 15 - WHEN THESE TERMS END
We may stop this agreement or turn off your access to the Services (or any portion) whenever we want, without notice, and you still have to pay anything you owe through that date.
Even after this agreement ends, these parts keep going: Intellectual Property, Feedback, Termination, No Warranties, Limits on Liability, Indemnity, Severability, No Waiver; Full Agreement, Transfer, State Law, Privacy Rules, and anything else that's meant to keep working after the agreement ends.

SECTION 16 - NO WARRANTY PROMISE
What we show on or through the Services is just general info. We don't promise it's right, full, or useful. Everything you do based on it is your own choice and your own risk. We're not responsible if you or anyone else trusts this material and something bad happens.
EXCEPT WHERE Kolamar SAYS OTHERWISE, THE SERVICES AND ALL THINGS YOU CAN BUY THROUGH THEM COME AS-IS AND AVAILABLE-AS-IS, WITH NO STATEMENTS, GUARANTEES, OR TERMS OF ANY TYPE, WHETHER STATED OR SUGGESTED, INCLUDING ALL ASSUMED TERMS ABOUT SELLING, QUALITY, FITTING YOUR NEEDS, LASTING, OWNERSHIP, AND NOT BREAKING ANYONE'S RIGHTS. WE DON'T PROMISE YOUR USE OF THE SERVICES WILL RUN WITHOUT STOPS, BE FAST, BE SAFE, OR HAVE NO GLITCHES. YOUR STATE OR REGION MIGHT NOT LET US REMOVE SOME GUARANTEES, SO THE ABOVE MIGHT NOT AFFECT YOU.

SECTION 17 - WHAT WE DON'T OWE YOU
TO THE MOST THAT THE LAW LETS US, Kolamar, OUR PARTNERS, BOARD MEMBERS, WORKERS, RELATED COMPANIES, HELPERS, OUTSIDE WORKERS, GIVERS OF RIGHTS, AND SHOPIFY AND ITS PARTNERS, SHALL NOT OWE YOU FOR ANY HURT, LOSS, DEBT, OR ANY STRAIGHT, UNPLANNED, EXTRA, PUNISHING, UNUSUAL, OR LINKED DAMAGES OF ANY KIND, INCLUDING LOST MONEY, MISSED INCOME, LOST FUNDS, NO MORE DATA, NEW COST, OR ANYTHING THE SAME, WHETHER FROM A DEAL, FAULT (WITH OR WITHOUT INTENT), HARD LIABILITY OR ELSE, COMING FROM YOUR USE OF THE SERVICES OR ANYTHING YOU GET FROM THE SERVICES, OR FOR ANY OTHER REASON TIED TO YOUR USE OF THE SERVICES OR ANYTHING, ALSO ANY FAULTS IN ANY WRITING, OR ANY LOSS OR HURT THAT COMES FROM USING THE SERVICES OR ANYTHING FROM IT, EVEN IF WE KNEW IT MIGHT HAPPEN.

SECTION 18 - PROTECTING AND DEFENDING US
You agree to shield and protect Kolamar, Shopify, and our related companies, business associates, board members, workers, helpers, outside workers, and those giving us rights from any costs, harms, or legal debts to a third party, including what lawyers charge, that come from (1) you breaking these Terms or what they reference, (2) you breaking any law or hurting someone's rights, or (3) the way you get to and use the Services.
We'll let you know about any legal situation we need you to cover for. If we don't tell you right away, you still have to cover for it unless we really lose out. We can manage and settle that legal situation at your cost and with any lawyer we pick, but won't settle anything that needs you to do something without asking first (and you can't say no without good reason). Help us out in these legal situations, including by handing over papers we need.

SECTION 19 - BROKEN PARTS
If any part of these Terms is found to be against the law or can't be used, that part will still work to the furthest the law allows. Taking that part out won't hurt any other parts of these Terms.

SECTION 20 - NO WAIVER AND WHOLE DEAL
If we don't use or apply some part of these Terms, that doesn't mean we're giving it up.
These Terms of Service and any rules we put on this site or for the Services make up the whole deal between you and us and decide how you use the Services. This beats any earlier or other agreements, talks, and offers, whether said or typed, between you and us (also any old versions of these Terms).
We won't read these Terms in a way that works against the person who wrote them.

SECTION 21 - YOU CAN'T TRANSFER YOUR RIGHTS
You can't hand off, swap, or give this Agreement or what you're allowed to do under these Terms to anyone else—if you try, it won't work. We can pass on this Agreement and what we're allowed to do without telling you or getting your say-so.

SECTION 22 - WHICH STATE'S LAWS APPLY
The laws of the U.S. state or region where Kolamar is based govern these Terms of Service and any other deals we make with you. You and Kolamar both agree that courts in that location have the power to hear cases.

SECTION 23 - HEADINGS DON'T MATTER
The section titles in this deal are just for easy reading and don't change what these Terms mean or do.

SECTION 24 - WE MAY UPDATE THESE TERMS
The latest version of these Terms of Service is always on this page.
We can update, edit, or swap out any section of these Terms whenever we want by putting the new version on our site. It's up to you to look at the site now and then for updates. If the Terms change in a big way, we'll notify you as the law requires, and the changes start on the date in the notice. If you keep using the Services after we post changes, you're accepting the new Terms.
